Legal Age to Buy a Vape in the UK, Including Nicotine Pouches
Two questions come up all the time. How old do you have to be to buy a vape? And is it the same age for nicotine pouches? This page answers both in plain words, one step at a time.
It also explains what changes on 29 October 2026, who is allowed to buy for whom, and what it means when you order a bigger pack. You do not need any legal background to follow it.
How we checked this: we read the GOV.UK guidance Selling vaping and nicotine products on 12 October 2026. GOV.UK shows that page was last updated on 12 August 2026. Rules can change, so please check GOV.UK again before you rely on anything here. This page is general information. It is not legal advice.
Legal Age to Buy a Vape in the UK, The Short Answer
The legal age to buy a vape in the UK is 18. That is the same in England, Scotland, Wales and Northern Ireland. From 29 October 2026, the same age of 18 applies to every vaping product and every nicotine product, and that includes nicotine pouches.
Here is the short version in one list.
- Vapes with nicotine: 18 and over.
- Vapes without nicotine: 18 and over from 29 October 2026. In Scotland this was already the case.
- Nicotine pouches: 18 and over from 29 October 2026.
- E-liquid, pods and vape kits: all count as vaping products, so the buyer must be 18 or over.
- Buying for someone under 18: this is an offence for the adult who buys.
Vapes: 18 and Over
For vapes that contain nicotine, the age was already 18. What is changing is the list of products the rule covers. GOV.UK says the new rule covers vaping products as a whole, which means devices and e-liquid. In England, Wales and Northern Ireland, it replaces an older rule that only covered vapes with nicotine in them.
So if you have wondered whether a vape with no nicotine is treated differently, the answer from 29 October 2026 is no. It is age restricted in the same way.
Nicotine Pouches and the 29 October 2026 Change
Nicotine pouches were not covered by the earlier age rules, and that is why this date matters. GOV.UK describes them as tobacco free pouches that contain nicotine powder. From 29 October 2026 they sit in the same group as vapes for the age of sale. We go through pouches in more detail further down this page.
How Old Do You Have to Be to Vape?
People often ask this in a slightly different way. They type "how old do you have to be to vape" or "what age can you vape". It is the same question.
The law is written about selling and buying. A shop cannot sell to anyone under 18, and an adult cannot buy for someone who is under 18. So the practical answer is easy. You need to be 18 or over, because nobody can lawfully sell you a vape before that.
A few situations cause most of the confusion, so here they are one by one.
- A parent says yes. That does not change the rule. A 16 year old cannot buy a vape with a parent's permission, and a parent who buys one for them would commit an offence.
- A friend or older brother or sister offers to buy it. The answer is the same. Buying for someone under 18 is the offence, even if it is meant as a favour.
- A multipack. The legal age to buy a vape Box of 5 is still 18. Pack size does not change the rule.
- A vape with no nicotine. It is age restricted from 29 October 2026, and it already was in Scotland.
- Your 18th birthday. You can buy on the day you turn 18, not before. A shop may still ask to see ID to prove your date of birth.

How Old to Buy Nicotine Pouches in the UK
Nicotine pouches are small bags that people place under the lip. They hold nicotine powder and they are described by GOV.UK as tobacco free. They are not vapes, but the government has decided they need the same age limit.
So how old do you have to be to buy nicotine pouches? From 29 October 2026 it is 18. Until that date, they were not covered by the earlier age rules. After that date the age of sale is 18, and it applies to online shops as well as shops on the high street. Anyone who sells nicotine pouches to a person under 18 will be breaking the law.
| Product | Before 29 October 2026 | From 29 October 2026 |
|---|---|---|
| Vapes with nicotine | 18 and over | 18 and over |
| Vapes without nicotine (England, Wales, Northern Ireland) | Not covered by the older rule | 18 and over |
| Vapes without nicotine (Scotland) | Already 18 and over | 18 and over |
| Nicotine pouches | Not covered by the earlier age rules | 18 and over |
If you want to know how pouches work in daily use, our nicotine pouch guide explains it in simple steps. Please remember it is for adults only.
What Counts as a Vape Product
GOV.UK uses two phrases: "vaping products" and "nicotine products". In everyday words, here is what falls under them.
- Vape kits and devices, whether they come prefilled or you refill them yourself.
- Pods that go into a kit.
- E-liquid, including nicotine salt bottles.
- Nicotine pouches.
The age is the same for all of them. A pack of pods needs the same 18 and over check as a full kit. The same is true if you buy e-liquid on its own, for example our 10ml e-liquid bottles. The legal age to buy a vape in bulk, such as a full case of e-liquid, is the same as for one bottle.
One point catches people out. A product being "nicotine free" does not remove the age limit. From 29 October 2026, the age limit follows the product type, not the nicotine strength.
Age Checks When You Order Online
GOV.UK says the age of sale applies to online retailers. It also says customers should expect to show ID if they are asked to prove their age. A seller must be satisfied that the buyer is 18 or over. A seller has a defence if it took all reasonable steps to avoid selling to someone under age.
What GOV.UK does not do yet, for England, Wales and Northern Ireland, is set one exact method for online checks. It says those regulations "will be debated in Parliament in due course". In Scotland, sellers already have to run an age verification policy, and that now extends to nicotine products from 29 October 2026.
What You May Be Asked For
Different shops check in different ways. Based on what other UK shops publish about their own checks, these are common:
- Matching your name, date of birth and address against records at checkout.
- Asking you to upload photo ID if the match does not work.
- A check at the door when the courier delivers.
The ID most shops accept is a passport, a photocard driving licence, or a proof of age card with a PASS logo. These are shop practices. They are not one national rule.
You may also hear the words "Challenge 25". That is a policy many shops use, where staff ask for ID from anyone who looks under 25. It is not the law. The law only sets the age at 18.
If you want to know exactly how age is checked on our orders, ask us before you order and we will tell you.
Legal Age to Buy a Vape Wholesale, Do Bulk Orders Change It?
No. A bigger order does not lower the age and it does not skip the check. The legal age to buy a vape wholesale, or in a single pack, is the same 18.
The question about the legal age to buy a vape wholesale comes up because people think of bulk buying as something different from a shop visit. For many products it is. For age, it is not. The seller must still be satisfied that the person buying is 18 or over, and the same offence applies if an adult buys for someone under 18.
The legal age to buy a vape in bulk is also the same for pods, e-liquid and pouches. If you are looking at wholesale nicotine pouches, the 18 and over rule applies from 29 October 2026 in the same way as it does for a single pack.
A seller may ask for more proof on a larger order. That would be the seller's choice. It is not a rule we can point to in the GOV.UK guidance, so we do not want to present it as one.
Buying a Box of 10 or Box of 5 for Someone Else
Think about a simple case. You order a pack, and someone you know asks if you can get one for them as well. Whether that is fine depends on one thing: how old that person is.
GOV.UK says it is an offence for anyone aged 18 or over to buy, or try to buy, a vaping or nicotine product on behalf of someone under 18. The buyer is the person who commits the offence. If the person who will end up with the vape is under 18, do not buy it. That is true for a single device, a Box of 5 or a Box of 10.
The legal age to buy a vape Box of 5 is the same as it is for one vape. It is 18 for you, and the product must not be for someone younger. If you are looking at Box of 5 vape kits, that is the rule to keep in mind.
What you do with a pack after you buy it, for example if you share it with other adults, is for you to manage, and we cannot give legal advice on it. The GOV.UK page is the best place to check the exact wording of the law.
Is It Different in Scotland, Wales or Northern Ireland?
The age is the same everywhere in the UK. It is 18. Some of the detail around it is not the same, and this is something many guides skip. Here is what GOV.UK says.
- England, Wales and Northern Ireland: the new rule replaces an older one that only covered vapes with nicotine. It now covers all vaping products and nicotine products. The rules on how sellers must check age are still to come.
- Scotland: vapes with and without nicotine were already age restricted. The new rules extend this to all nicotine products, including pouches. Sellers must already run an age verification policy.
- Penalty amounts: these are not the same in every nation. Northern Ireland shows a different fixed penalty, and GOV.UK says it is subject to approval by the Northern Ireland Assembly.
If you live in one of these nations and the detail matters to you, read the nation notes on the GOV.UK page itself. We have kept ours short on purpose.
What Happens If the Rule Is Broken
The sections above are about what the law asks of sellers and buyers. Here is what GOV.UK says about what follows when it is broken.
- Selling to someone under 18: a fixed penalty notice of £200 in England, Wales and Scotland, or £250 in Northern Ireland (subject to approval). A seller can also be taken to court. Fines in court can reach £2,500 in England, Wales and Scotland and £5,000 in Northern Ireland.
- Buying for someone under 18: the same fixed penalty amounts apply to the adult who buys.
- A defence for sellers: a seller can show it took all reasonable steps to avoid the offence.
These figures can change, and the court limits are different for some offences. Please use the GOV.UK page for the full table.
